These Terms of Service (“Terms”) govern your use of furtivalabs.com and any purchase from Furtiva Labs, a brand of Athena Group LLC (“we,” “us,” “our”). By accessing this site or placing an order, you agree to these Terms. If you do not agree, do not use this site.
1. Research Use Only
All products sold by Furtiva Labs are research chemicals intended solely for in-vitro laboratory research and scientific experimentation. Our products are not drugs, dietary supplements, food, or cosmetics. They are not approved by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition.
Products are not for human or animal consumption, injection, or any form of bodily introduction. Nothing on this website constitutes medical advice, and no statement should be interpreted as a claim of therapeutic benefit.
2. Purchaser Eligibility and Representations
By placing an order, you represent and warrant that:
- You are at least 21 years of age.
- You are a qualified researcher or are purchasing on behalf of a research institution or laboratory, with the knowledge and facilities to handle research chemicals safely.
- You will use all products exclusively for lawful laboratory research purposes.
- You will not use, sell, or provide any product for human or veterinary consumption or use.
- You will comply with all federal, state, and local laws that apply to your purchase, possession, and use of these products.
We reserve the right to refuse or cancel any order, and to close any account, at our sole discretion — including where we reasonably believe a product is intended for human use (for example, requests for dosing, administration, or personal-use guidance).
3. Orders and Payment
Orders are confirmed only after full payment is received. Payment is accepted by Zelle or ACH bank transfer as described at checkout. The order number must be the only text in the payment memo or reference field; payments that do not follow this requirement cannot be matched to an order and may be refunded and the associated order cancelled. Orders remain on hold until payment is confirmed; we may cancel unpaid orders. Prices and availability may change without notice.
4. Shipping, Returns, and Refunds
Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund & Returns Policy.
5. Product Information
Product descriptions and certificates of analysis are provided for research reference. We make reasonable efforts to ensure accuracy but do not warrant that descriptions are error-free. Purchasers are responsible for independently verifying the suitability of any product for their research.
6. Assumption of Risk and Indemnification
You assume all risks associated with the handling, storage, and use of products purchased from us. You agree to indemnify and hold harmless Furtiva Labs, its owners, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your purchase, possession, use, or misuse of any product, or from your breach of these Terms.
7. Disclaimer of Warranties
Products are provided “as is” for research purposes. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
8. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from a purchase shall not exceed the amount you paid for the product giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages.
9. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Utah.
10. Changes
We may update these Terms at any time. Changes take effect when posted. Continued use of the site constitutes acceptance of the revised Terms.
